Ziggma Analytics, Inc. (“Ziggma,” “we,” “our,” or “us”) operates the Ziggma website and related applications and services (together, the “Site”). By creating an account or otherwise using the Site, you agree to be bound by these Terms of Use (these “Terms”) and by our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms and our Privacy Policy, please do not access or use the Site. The Site is intended for individuals who are at least 18 years old, and by using it you represent that you meet this requirement. If we learn that a registered account belongs to someone under 18, we will close that account.
We may, at any time and at our discretion:
revise these Terms;
change the Site, including by adding, modifying, or discontinuing features; or
introduce new fees for use of the Site, on reasonable notice.
Continuing to use the Site after we make a change means you accept the updated Terms. We encourage you to review this page from time to time.
Content on the Site — including newsletters, educational emails, and social posts — is not a recommendation that any specific security, portfolio, transaction, or strategy is right for you personally. Our data and information providers are not advising you individually about any particular security or investment decision. Where content on the Site could be read as investment advice, it reflects general, impersonal analysis rather than guidance tailored to your circumstances. Investing in any security carries risk, and our discussions of a security won't necessarily spell out its specific risk factors. Securities with low market capitalization or thin public float, which may be discussed on the Site, carry added risk — including greater volatility and lower liquidity — compared with larger companies.
The Site may include opinions on securities from time to time. Employees, consultants, or freelancers with a personal interest in a security they write about are required to disclose that interest to the Ziggma community. The Site may reference earlier articles or opinions we've published. These references may be partial, selective, or outdated, since markets and the underlying data change continuously.
Everything on the Site reflects the date it was published and may be superseded by later market events. Keep your browser's cache settings current to make sure you're seeing the latest data.
The Site doesn't provide tax, legal, insurance, or investment advice, and nothing on it is an offer or solicitation to buy or sell any security. Ziggma is not a broker-dealer, is not a registered investment adviser, and does not act as your fiduciary through your use of the Site. The Site and its contents — text, graphics, software, articles, and other materials (“Content”) — along with related trademarks and logos, belong to Ziggma or its licensors. You may view, download, or print Content for your own personal, non-commercial use, provided you keep any copyright notices intact; using the Site doesn't give you any ownership rights in it, and we reserve every right not expressly granted here.
Certain data on the Site is licensed from our data providers — EndOfDayHistoricalData, Intrinio, Plaid, and SnapTrade — and none of them warrant that data as accurate, complete, or current, or take responsibility for damages arising from its use. Past performance is no guarantee of future results.
The Site may link to third-party websites or display third-party content we don't control, endorse, or review. Use of any linked site is at your own risk and governed by that site's own terms — we aren't responsible for the legality, accuracy, or consequences of content or products found there or through any app we make available.
You're welcome to link to Site content. If you'd like to reprint, republish, or otherwise redistribute Ziggma content, contact us for written permission. Ziggma™ and related marks belong to Ziggma or an affiliate; other marks on the Site belong to their respective owners. This section survives any termination of these Terms.
You may not copy, sell, license, decompile, republish, redistribute, or create derivative works from Site Content, or exploit it for any purpose beyond your own personal, non-commercial use, without our prior written permission — doing so is a violation of our rights and may expose you to liability.
In using the Site, you also agree not to:
interfere with other visitors' use of the Site, including through hacking or defacing it; use the Site unlawfully; imply that your statements are endorsed by us without our written consent; reverse-engineer, decompile, or modify any part of the Site; disable or alter the Site's functioning or appearance; frame or mirror the Site without written authorization; use bots, scrapers, or similar tools to extract Site data outside features we provide for that purpose; collect information about other visitors without consent; or transmit viruses or other harmful code.
You agree to comply with applicable law while using the Site. Because our services connect to financial accounts, we monitor for activity consistent with our anti-money-laundering and counter-terrorist-financing obligations, and we may restrict access where such concerns arise.
We reserve the right to close, suspend, or limit access to your Subscription, account and/or the Site in the event your use violates such obligations or if, after reasonable inquiry, we are unable to obtain information about you which is required to verify your identity. We may require you to provide additional information or documents to verify your identity, including your date of birth, physical address, taxpayer or other identification number, your physical address, government issued identification document or other information that will allow us to reasonably identify you.
We may suspend, limit, or close your account if your use raises these concerns, or if we can't verify your identity after a reasonable request — which may include your date of birth, address, tax ID, or a government-issued ID. Creating an account means you agree to: keep no more than three (3) accounts; keep your login credentials confidential rather than sharing or transferring them; take responsibility for all activity under your account and notify us promptly of any suspected unauthorized use. You may be liable for losses arising from unauthorized use of your account; we won't be liable for losses you incur from such unauthorized use.
We may terminate your access to the Site at our discretion.
If you send us feedback or suggestions about the Site, you agree we can use it freely and without compensating you, and that any related intellectual property becomes ours.
The Site, and anything obtained through it, is provided “as is,” without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, title, or non-infringement. To the fullest extent the law allows, Ziggma and its officers, directors, employees, and data providers disclaim all such warranties.
These exclusions may not apply where local law doesn't allow them.
We don't promise the Site will be uninterrupted, error-free, or secure, or that it's free of harmful components — you use it at your own risk, and nothing said on the Site creates a warranty beyond what's stated here.
To the fullest extent the law allows, Ziggma and its officers, directors, employees, and data providers won't be liable for lost profits or indirect, incidental, consequential, special, exemplary, or punitive damages arising from the Site, even if advised such damages were possible. Your only remedy for dissatisfaction with the Site is to stop using it, and our total liability for any claim will not exceed what you paid us in the six (6) months before the claim arose.
This limitation may not apply where local law doesn't allow it.
You agree to defend and indemnify Ziggma and its officers, directors, employees, and agents against claims, damages, and reasonable expenses (including attorneys' fees) arising from your breach of these Terms, your use of the Site, or your violation of another person's rights. This obligation survives termination of these Terms.
We may suspend or terminate your access to the Site without advance notice, including for reasons such as:
breach of these Terms or related agreements;
a request from law enforcement or a government or regulatory authority; or
repeated infringement of third-party intellectual property rights.
We respect the intellectual property rights of others and expect our users to do the same, and may terminate access for users who infringe our rights.
Intrinio and its affiliates aren't responsible for the accuracy or completeness of the financial and holdings data they supply to the Site (the “Intrinio Services”), and aren't liable for interruptions, omissions, or resulting damages.
The Intrinio Services aren't investment advice, and nothing in them is a recommendation to buy, sell, or hold any investment.
Intrinio and its affiliates retain all proprietary rights in the Intrinio Services.
You may use the Intrinio Services only for lawful, authorized, internal purposes, and may not redistribute them to any third party without Intrinio's prior written approval.
If our agreement with Intrinio ends, your access to the Intrinio Services ends too, and Intrinio may enforce these terms against you directly as an intended beneficiary.
Paid Ziggma subscriptions are billed at the rates shown on the Site, which we may revise on reasonable notice. The account rules described in Section 6 above apply to your subscription too.
Unless we say otherwise in writing, you may not share subscription content with others, and subscription fees are non-refundable. We may cancel a subscription that breaches these Terms without a refund.
When you delete your Ziggma account, we permanently erase your stored data — your first name, last name, and email address — subject to any period we're required to retain records under applicable law or our regulatory obligations. To delete your account, go to “My Account” in the top-right menu, enter your email, and select “Delete Account.” For written confirmation that your data has been deleted, email contact@ziggma.com.
Ziggma reserves the right to limit the number of brokerage or investment accounts you may link to the Site.
By creating an account and/or subscribing to a Ziggma plan, you agree to receive communications that are integral to the Ziggma service and features. This includes transactional emails (account confirmation, password resets), feature-based content such as the Market Scope newsletter, educational materials, and Smart Alert notifications.
While these communications are provided as part of your Ziggma membership features, you maintain full control over your inbox. You may opt-out of the Market Scope newsletter or any non-transactional emails at any time via the "Unsubscribe" link in the email footer or through your account settings. Ziggma will never share your personal data with third parties for third-party marketing purposes.
Ziggma will not be liable for any delay or failure to perform its obligations under these Terms where that delay or failure results from causes beyond our reasonable control — including natural disasters, war, terrorism, civil unrest, labor disputes, internet or telecommunications failures, power outages, government action, or an outage or failure of a third-party service we rely on to operate the Site, such as our data, hosting, or account-aggregation providers. We'll make reasonable efforts to restore affected services promptly; if a disruption continues for an extended period, either party may terminate the affected service by written notice.
The Site is meant for use in jurisdictions where doing so is lawful. If you access it elsewhere, you're responsible for complying with local law; we may restrict availability by location at our discretion.
These Terms, together with our Privacy Policy, are the entire agreement between you and Ziggma about your use of the Site, replacing any earlier agreements on the same subject. They're governed by Delaware law, and you agree that Delaware's federal and state courts have exclusive jurisdiction over any dispute, waiving objections to venue there. If a court finds part of these Terms unenforceable, the rest stays in effect; our failure to enforce a provision once doesn't waive our right to enforce it later. Section headings are for convenience only, and we may ask you to sign a physical copy of these Terms.
